Punishments for Repeat DUI Offenders in Tennessee
Getting caught driving drunk is a serious offense, which you already know because you have been through this already if this is your second offense. According to NHTSA studies, a person with a prior DUI conviction has 4.1 times the risk of being involved in a fatal vehicle accident. Another study reported that the chances of being involved in a fatal car crash increased with each subsequent DUI arrest.
Judges in Tennessee come down hard on DUI offenders, and second or subsequent offenders will find significantly steeper penalties and fines that are meant to serve as a deterrent.
DUI second offense penalties include:
- 45 days to 11 months, 29 days in jail
- $600-$3,500 mandatory fine
- License revoked for 2 years
- Vehicle seizure and or forfeiture
- Mandatory alcohol and drug treatment program
- Mandatory Ignition Interlock Device at your own expense
- If you have two DUI convictions in 5 years, the Ignition Interlock Device is required for 6 months after reinstatement at your expense
- You are required to pay restitution to any person suffering personal injury or loss
DUI third offense penalties are even tougher:
- 120 days to 11 months, 29 days in jail
- $1,100 to $10,000 mandatory fines
- License revoked for 6-10 years/NO restricted license available
- Vehicle seizure and or forfeiture
- Mandatory alcohol and drug treatment program
- If two (2) convictions of DUI in 5 years, Ignition Interlock Device required for 6 months after reinstatement at your expense
- You are required to pay restitution to any person suffering personal injury or loss
The ignition interlock device is now a mandatory DUI penalty for repeat DUI offenders. The minimum cost for the device is $60 per month. Also, if you are a DUI repeat offender you may be denied bail if the judge decides that you are a danger to the community.
